Home Improvement Consumer Protection Act of Pennsylvania

Effective July 1, 2009

The following summary is a brief overview of some of the main components of the Act as provided by Pennsylvania Deputy Attorney General Jesse Harvey. Right of Rescission

The Consumer Protection Act, Section 201, mandates the following language be added to each contract and must be placed "... in immediate proximity to the space reserved in the contract for the signature of the buyer or on the front page of the receipt if a contract is not used and in bold face type of a minimum size of ten points, a statement in substantially the following form:

“You, the buyer, may cancel this transaction at any time prior to midnight of the third business day after the date of this transaction. See the attached notice of cancellation form for an explanation of this right.”

This informs consumers that they may cancel the contract without penalty regardless of where the contract was signed within three business days of the date of signing

For a home improvement contract in which the total price is more than $1000, a contractor cannot receive a deposit in excess of:

(a) one-third of the home improvement contract price; or

(b) one-third of the home improvement contract price plus the cost of special order materials that have been ordered
